Terms of Service

These terms are applicable to all commissioned pieces.
In case of any disagreements with the terms, they may be negotiated prior to the payment for the commissioned piece.

1. GENERAL TERMS

  • Every commissioned piece will include a subtle signature that cannot be removed.
  • I reserve the right to post the completed commissioned pieces on my Twitter and Patreon accounts.
  • Prices are subject to change depending on the demand.
  • I reserve the right to reject any commission I am not comfortable with completing for any reason.
  • All characters depicted in commissioned pieces must be explicitly stated as being 18 years of age or older. This is a strict requirement and applies regardless of the character's original age in source material, if applicable.

2. PAYMENT

  • Payments can be made in USD or any other currency with a conversion rate calculated accordingly.
  • Commissions can be paid fully upfront or with a custom percentage depending on the length of the commission.
  • Payment should only be sent after I have confirmed your slot and requested the payment.

3. PROCESS AND DELIVERY

  • You will receive a notification when I commence work on your commission. At this stage, you forfeit the right to request a refund (refer to point 7 for more on refunds).
  • If any aspect of the commission is unclear while I am working on it, I will discuss it with you to ensure the final product meets your expectations.
  • The number of discussions will depend on the complexity of the work.
  • During the discussion process, you can receive work-in-progress versions of the commission, which may be watermarked and smaller in resolution than the final product.
  • The duration to complete a commissioned piece can vary due to factors like health, complexity of the work, other commitments, and convention seasons.
  • If any factors arise that will delay the estimated delivery time, I will notify you as soon as possible.
  • Upon completion of the piece, you will receive the full-resolution commission.

4. REVISIONS

  • You are entitled to unlimited rounds of revisions on the commissioned piece.
  • A fee may be charged for revisions, unless the request is due to a misunderstanding on my part.
  • Once the commission is complete, revision requests will no longer be accepted.

5. COPYRIGHT / USAGE POLICY

  • As CrimsonSFM (the artist), I retain all rights to the completed commission, not the buyer. This allows me to use the copyrighted artwork to:
    • Promote my work
    • Display the work on any platform of my choosing (website, social media, etc.)
    • Post the work wherever I deem suitable
  • The buyer is not permitted to:
    • Use the commissioned piece for personal use unless agreed upon beforehand (you may post the work on your personal social media profiles and forums, etc.)
    • Use the commission to promote anything
    • Use the commission on their YouTube channel or in monetized videos unless the animation is not the primary subject for the earnings.
    • Commit any actions that are considered copyright infringement, such as:
      • Using the copyrighted commission for commercial purposes (i.e., earning money from it) without my permission
      • Claiming the work as your own
      • Distributing the work without my permission

6. CANCELLATION

  • You can cancel your commission at any time before I start work on it.
  • If I have already begun work on the commission, you can still request to cancel, but a cancellation fee will be assessed based on the amount of work completed. Please note that the percentage of progress reported, especially in animation, is only an estimate and may not precisely reflect the actual amount of work done.

7. REFUNDS

  • If I am unable to complete your commission, you are entitled to a full refund.
  • If you request a refund after I have started work on the commission, a partial refund may be given based on the amount of work completed. Again, be aware that the reported percentage of progress, particularly in animation projects, is an approximate measure and may not accurately represent the completed work.
  • No refunds will be given once the commission is complete and the final product has been delivered.

8. REWARDS PROGRAM (OMEGA POINTS) AND COMMISSION FULFILLMENT

  • Users can earn omega points by participating in certain activities, such as sharing models, audio, reporting violations, and submitting ideas.
  • Omega points can be exchanged for free services on our website.
  • The specific activities that earn omega points and the services that can be redeemed with them will be posted on the website and may be subject to change at any time.
  • In scenarios where a commission is requested (regardless of whether work has commenced) and is awaiting client action or response (e.g., payment, final approval, confirmation, or any other required interaction), the following applies:
    • If the client fails to take the necessary action or respond within a specified period (e.g., 30 days) after being contacted, the commission request will be considered as declined.
    • In such cases, any omega points or free request credits allocated for the commission will be forfeited and will not be refunded or reinstated.
    • This policy is designed to ensure efficient management of commission requests and to respect the planning and resource allocation involved in preparing for each commission.
  • Clients are encouraged to maintain active communication regarding their commission requests to avoid forfeiture of their points or credits.

9. VIOLATIONS OF TERMS OF SERVICE

  • Users who violate the terms of service will be subject to account suspension or termination.
  • This will result in the forfeiture of any omega points earned, and the user will be denied access to any videos posted on the website.
  • The duration of the suspension will be determined on a case-by-case basis and may range from a temporary suspension to a permanent termination.
  • Actions that will result in a suspension or termination include but are not limited to plagiarism, sharing copyrighted content, and any other actions deemed unacceptable by the website.
  • Users who have been suspended may appeal the suspension by emailing contact@crimsonsfm.com.

10. LIABILITY

  • I am not responsible for any damages or losses that may occur as a result of using the commissioned product.
  • I am also not responsible for any incorrect or incomplete information provided by the buyer.
  • By commissioning me, you agree to these terms and conditions.

11. FINAL PRODUCT

  • The final product of the commissioned piece will be delivered in a digital format, either via email or through a file sharing service such as Google Drive.
  • The final product will be in a high-resolution format, suitable for printing or displaying on screen.
  • The final product will include a watermark or other identifying mark, unless previously agreed upon.
  • It is the buyer's responsibility to save and back up the final product. I am not responsible for any loss or damage to the final product after delivery.
