Terms of Service
These Terms of Service ("Terms") govern all 3D animation commissions and related services
provided by CrimsonSFM.
By commissioning work or using this website, you agree to these terms. In case of disagreement,
terms may be discussed before payment is made.
1. GENERAL TERMS
- Every commissioned animation will include a subtle signature or mark that cannot be removed unless otherwise agreed.
- I reserve the right to post completed animations on platforms such as X, Patreon, or my website for promotional purposes.
- Prices are subject to change depending on demand and project complexity.
- I reserve the right to refuse any commission I am not comfortable with for any reason.
- All characters depicted in commissioned works must be clearly and verifiably adults (18 years of age or older). CrimsonSFM will not accept or create any commission that depicts, references, or is based on characters who are canonically or visually under 18 years old in a sexual or explicit context.
2. PAYMENT
- Payments are accepted in USD or equivalent currencies based on the current conversion rate.
- Payment is due only after I have confirmed your slot and requested it.
- Work will not begin until payment or the agreed deposit has been received.
- Transaction fees or currency conversion costs are the client's responsibility unless stated otherwise.
3. PROCESS AND DELIVERY
- You will receive a notification when production begins. Once production has started, refund rights are limited (see Section 7).
- Work-in-progress previews (WIPs) will be provided as low-resolution, watermarked video files—such as render previews.
- WIPs are for approval of animation timing, poses, lighting, and camera work, not for evaluating final render quality.
- Final delivery will be made digitally via a file transfer service in video format (MP4, MOV, etc.).
- It is the client's responsibility to download and back up all delivered files once received.
- Estimated delivery times vary depending on render length, complexity, and render farm availability. Any delays will be communicated promptly.
- Some complex scenes may be simplified or omitted when using Light or Medium styles due to their reduced animation complexity.
3A. CLIENT-PROVIDED REFERENCE MATERIALS
- Clients may optionally provide reference images or other visual materials for the purpose of completing a custom animation commission.
- The client confirms that they own or have the legal right to use and submit any reference materials provided.
- By submitting reference materials, the client grants CrimsonSFM a limited, non-exclusive license to view, store, and use such materials solely for the purpose of fulfilling the commissioned animation.
- Reference materials are not made public and are accessible only to CrimsonSFM. They are not reused, redistributed, or used for training, promotion, or any purpose unrelated to the specific commission, unless explicitly agreed otherwise.
- CrimsonSFM reserves the right to refuse or discontinue a commission if the provided reference materials violate these Terms or applicable law.
4. REVISIONS
- Minor revisions (small timing tweaks, camera shifts, or lighting adjustments) are unlimited during early animation stages.
- Major revisions (changes to choreography, camera path, or major scene direction) are not included in the commission price and will incur additional fees, which must be approved before implementation.
- Re-rendering or compositing changes requested after final render delivery may incur additional costs.
- If a revision is needed due to my error or miscommunication, it will be done at no extra cost.
- Once the final animation is approved and delivered, further revisions are not accepted.
5. COPYRIGHT / LICENSE AND USAGE POLICY
- As CrimsonSFM (the artist), I retain all copyrights and moral rights to the completed animation. The client does not own the underlying project files or raw assets unless explicitly purchased.
- I may use commissioned animations for portfolio, promotion, or posting on my platforms (e.g., X, Patreon, website).
- Source project files are not included unless agreed upon and paid for separately.
- The client is granted a non-exclusive, non-transferable license for personal, non-commercial use of the final animation render(s). This includes posting on personal social media or forums.
- Commercial use—such as advertisements, monetized content, merchandise, or paid promotions—requires a separate commercial license.
- You may not claim the animation as your own or redistribute it without permission.
- Attribution (e.g., “Animation by CrimsonSFM”) is encouraged when posting publicly.
6. CANCELLATION
- You may cancel your commission any time before production begins for a full refund (minus processing fees).
- If production has begun, a cancellation fee will apply based on the estimated percentage of work completed (animation blocking, scene setup, rendering, etc.).
7. REFUNDS
- If I cannot complete your animation, you are entitled to a full refund.
- If you request a refund after work has begun, a partial refund may be provided, based on the amount of work completed and rendering costs incurred.
- No refunds will be given once the final animation is delivered and accepted.
8. REWARDS PROGRAM (OMEGA POINTS)
- Users can earn Omega Points by participating in site activities such as sharing models, reporting issues, or contributing ideas.
- Omega Points may be exchanged for free services listed on the site; availability and value may change without notice.
- If a commission is pending client response (e.g., payment or confirmation) for more than 30 days, it may be marked as declined and any used points forfeited.
- All Omega Points, Delta Requests, and Omega Requests expire 12 months (1 year) from the date they are earned or issued, unless otherwise stated. Expired points or requests have no cash value and cannot be restored or exchanged.
9. PROHIBITED CONTENT
- Requests containing illegal or infringing content are prohibited.
- Sexual or explicit content involving minors is strictly forbidden under all circumstances.
- I reserve the right to reject or discontinue any project that violates these terms or applicable law.
10. LIABILITY AND INDEMNIFICATION
- I am not responsible for damages, losses, or claims arising from the use or inability to use the commissioned product.
- You agree to indemnify and hold harmless CrimsonSFM from claims or losses arising from your misuse of the animation or violation of these terms.
- My total liability is limited to the total amount paid for the commission, except where liability cannot be excluded or limited under Polish consumer protection law.
11. FORCE MAJEURE
If unforeseen events such as illness, equipment failure, natural disasters, or render farm issues occur, causing delays, I will inform you promptly. I am not liable for delays outside my reasonable control.
12. GOVERNING LAW
These Terms are governed by the laws of Poland. Any disputes shall be handled by the competent courts within Poland, without prejudice to mandatory consumer protection laws.
13. CHANGES TO TERMS
I may update these Terms from time to time. The latest version will always be available on this page, and continued use of my services constitutes acceptance of any changes.
